PHMSA’s FY 2023 HMIT grant funding priority is focused on ensuring hazmat employers and employees in underserved communities are properly trained on the Hazardous Materials Regulations (HMR).

For award consideration, nonprofit organizations must demonstrate expertise in conducting training programs for hazmat employees, and the ability to reach and involve in a training program a target population of hazmat employees. Properly planned and maintained training programs are essential for hazmat employees to ensure: hazmat employees receive initial and continuing training on the risks involved in transporting hazardous materials; the relevant training requirements in the Hazardous Materials Regulation (HMR) are met; and hazmat employees will be equipped to ensure their safety and the safety of others. Effective training of employees can reduce risk and the likelihood of hazmat incidents and accidents, which is key to ensuring that hazardous materials are transported safely.

PHMSA requires that applicants comply with all applicable federal financial assistance regulations and maintain an auditable accounting system that includes a detailed accounting and description of each grant expenditure. PHMSA measures performance based on the projects included in the approved financial assistance application and whether those projects fulfilled the needs outlined in the statement of need.

Period of Performance

The period of performance is a minimum of 12 months from the effective date of the award. An applicant may request a period of performance up to 24 months.

Eligible Applicants and Activities

The FY 2023 HMIT grant program is open to nonprofit organizations that demonstrate expertise in conducting a training program for existing hazmat employees, and the ability to reach and involve in a training program a target population of hazmat employees.

For the purposes of the HMIT grants program, a nonprofit organization is a business that has been granted tax-exempt status by the Internal Revenue Service (IRS) because it furthers a social cause and provides a public benefit.

Nonprofit organizations described in Section 501(c)(4) of the Internal Revenue Code that engage in lobbying activities as defined of the Lobbying Disclosure Act of 1995 are not eligible applicants. “For-profit” organizations are not eligible applicants for the HMIT grant program.

Hazmat employee, as defined at 49 U.S.C § 5102(3) and at 49 CFR § 171.8, means a person who:

  • Is employed on a full-time, part-time, or temporary basis by a hazmat employer and who during the course of such full-time, part-time or temporary employment directly affects hazardous materials transportation safety.
  • Is self-employed (including an owner-operator of a motor vehicle, vessel, or aircraft) transporting hazardous materials in commerce who during the course of such selfemployment directly affects hazardous materials transportation safety.
  • Is a railroad signalman;
  • Is a railroad maintenance-of-way employee; or
  • Is employed on a full-time, part-time, or temporary basis by a hazmat employer, or who is self-employed, who during the course of employment:
  • Loads, unloads, or handles hazardous materials.
  • Designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a package, container or packaging component that is represented, marked, certified, or sold as qualified for use in transporting hazardous material in commerce.
  • Prepares hazardous materials for transportation.
  • Is responsible for the safety of transporting hazardous materials; or
  • Operates a vehicle used to transport hazardous materials.

Hazmat employer, as defined at 49 U.S.C § 5102(4), means a person:

  • that employs or uses at least one hazmat employee on a full-time, part-time, or temporary basis; and who:
    • Transports hazardous materials in commerce.
    • Causes hazardous materials to be transported in commerce; or
    • Designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a package, container, or packaging component that is represented, marked, certified, or sold by that person as qualified for use in transporting hazardous materials in commerce.
  • A person who is self-employed (including an owner-operator of a motor vehicle, vessel, or aircraft) transporting materials in commerce; and who:
    • Transports hazardous materials in commerce.
    • Causes hazardous materials to be transported in commerce; or
    • Designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs or tests a package, container, or packaging component that is represented, marked, certified, or sold by that person as qualified for use in transporting hazardous materials in commerce; or
  • A department, agency, or instrumentality of the U.S. Government, or an authority of a state, political subdivision of a state, or an Indian tribe; and who:
    • Transports hazardous materials in commerce.
    • Causes hazardous materials to be transported in commerce; or
    • Designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a package, container, or packaging component that is represented, marked, certified, or sold by that person as qualified for use in transporting hazardous materials in commerce.
