Judge Freezes Accounts of Viet America Society Amid Embezzlement Allegations

Dated: October 20, 2024

A recent court ruling has led to the freezing of bank accounts belonging to the Viet America Society and its leaders. This decision follows a civil lawsuit filed by Orange County, which alleges that the nonprofit misappropriated millions in COVID relief funds intended for community services.

Key Takeaways

  • A judge ordered the freezing of accounts linked to the Viet America Society due to allegations of embezzlement.
  • The county claims over $10 million in federal COVID funds were misused.
  • The nonprofit’s leaders are under investigation and have invoked their Fifth Amendment rights.
  • A follow-up hearing is scheduled for January 2025.

Background of the Case

The controversy began when the Viet America Society received more than $10 million in federal COVID relief funds, primarily directed by Supervisor Andrew Do. These funds were intended to provide meals for the elderly and individuals with disabilities in the county. However, the nonprofit failed to meet several deadlines for submitting required audits and documentation, prompting the county to take legal action.

Allegations of Misuse

The county’s lawsuit, filed in August, accuses the Viet America Society and its leadership of embezzling funds meant for a meals program and a Vietnam War memorial. Allegations include:

  • Purchasing properties and luxury items with the funds.
  • Failing to provide adequate accounting for the expenditures.

Legal Proceedings

During a hearing on October 18, a San Diego Superior Court judge ruled that at least $4.2 million allocated for the meals program would be frozen. The county sought this court order to prevent the organization and its leaders from spending or transferring any funds received from the county.

Mark Rosen, the attorney representing the Viet America Society, argued that the county’s case is based on insufficient accounting practices and that the organization had delivered a report indicating only a minor amount of unaccounted funds. He stated:

  • The county discovered accounting requirements late, three years after services began.
  • The organization had provided the necessary services despite alleged accounting issues.

Ongoing Investigations

Rosen also mentioned that federal authorities had already frozen the accounts of the Viet America Society and some of its officers. The county’s lawsuit aims to extend this freeze during the civil proceedings. The attorney emphasized that the county’s demands for the return of all funds are excessive, given the minimal discrepancies in accounting.

Next Steps

A follow-up hearing is set for January 2025, where further developments in the case will be discussed. The outcome of this legal battle could have significant implications for the Viet America Society and its ability to operate in the future. As the investigation unfolds, the community remains watchful of the proceedings and their potential impact on local services.
